The rules

There are a few types of public inquiry depending on the type of scheme. They all follow different, but similar, rules.

General rules for all inquiries:
The Highways (Inquiries Procedure) Rules 1994

A local authority scheme that has been called in by the Secretary of State will follow the Town and Country Planning (Inquiries Procedure) (England) Rules 2000 (and may follow the compulsory purchase rules below)

A local authority scheme that has not been called in follows the Compulsory Purchase by Non-Ministerial Acquiring Authorities (Inquiries Procedure) Rules 1990

A Highways Agency scheme follows the Compulsory Purchase by Ministers (Inquiries Procedure) Rules 1994

When the inquiry is announced, the letter informing objectors will state which rules the inquiry will follow.
